The Québec Ministry of the Environment and the Fight Against Climate Change recently announced changes to the Regulation respecting the recovery and reclamation of products by enterprises. Since September 30, 2022, as per section 8.1, “no one may recover or reclaim a product covered by this Regulation, or entrust to another the recovery and reclamation of such a product, otherwise than as part of a recovery and reclamation program developed pursuant to section 5.”
Electronics Registry is operated by the Electronic Products Recycling Association/Association pour le recyclage des produits électroniques (“EPRA/ARPE”). EPRA/ARPE is a Recognized Management Organization which is governed by an agreement with the Société québécoise de récupération et de recyclage (“RECYC- QUÉBEC”), pursuant to the Environment Quality Act and the Regulation respecting the recovery and reclamation of products by enterprises.
Organizations that are registered and compliant with the framework defined by Electronics Registry and their sub-contractors provide services directly to communities in the province of Québec and do not provide services to EPRA/ARPE. These organizations and their sub-contractors may reference the Electronics Registry name(s) and trademark(s) upon written authorization, but do not have the right to use the name(s) and trademark(s) of EPRA/ARPE in any manner, anywhere in Canada.
If your organization collects, recovers, processes or reclaims regulated end-of-life electronics in Québec outside the designated EPRA-Québec program, you are required, as part of the initial phase, to register with the Electronics Registry. In the weeks following your registration, a member of the ElectronicsRegistry.ca team will reach out to you with further details about your obligations to meet this new compliance requirement.
